Terms of Use for Designers – Brick Empire (BrickWorld OÜ)

Last Updated: 21.05.2026

These Terms of Use (hereinafter referred to as the "Agreement") constitute a legally binding agreement between BrickWorld OÜ, a legal entity registered in the Republic of Estonia under registration number 17057051, (hereinafter referred to as the "Platform"), and you — an individual registering on the Site as an author (hereinafter referred to as the "Designer"). Registering on the Site as a Designer signifies your full and unconditional acceptance of all terms and conditions of this Agreement.

1. Terms and Definitions

  • Site — the internet resource located at brickempire.eu, including all its subdomains and software.
  • Digital Product — building instructions (in PDF format) and accompanying 3D models (in .io format) developed by the Designer.
  • Part List — a text or software file (e.g., in XML/CSV format) automatically generated by the Platform based on the .io file, containing a list of official elements, their quantities, and ID numbers necessary to build the model.
  • End Buyer — a user of the Site who purchases access to the Digital Product for personal use.
  • Moderation — the process of reviewing the Digital Product by the Platform Administration for compliance with the technical, aesthetic, and legal requirements of the Site prior to its publication.
  • Internal Balance — an account within the Designer's personal dashboard on the Site, reflecting the amount of funds due to the Designer and available for withdrawal.
  • Net Income — the amount received from the sale of the Digital Product to the End Buyer, less the commissions and fees of the external payment processing system (Stripe).

2. Designer Status and Registration

2.1 Registration as a Designer on the Platform is permitted exclusively to individuals (freelancers, self-employed persons) who have reached the age of 18 (or the age of majority in their country of residence).
2.2 Upon registration, the Designer is obliged to provide current, complete, and accurate information.
2.3 The Designer acknowledges that the Platform does not act as their employer or tax agent. The Designer is solely responsible for calculating and paying all applicable taxes and fees in their country of tax residence.

3. Submission, Moderation, and Publication Procedure

3.1 The Designer does not have the technical ability for instant and independent publication of Digital Products on the Site.
3.2 To place a Digital Product, the Designer agrees to upload and complete the following via the Site interface:

  • Building instructions in PDF format.
  • The 3D model file in .io format.
  • The "Additional" informational text field, where the Designer is required to manually list the names, unique characteristics, and exact quantities of any custom parts used in the model. Custom parts are defined as any elements absent from the official standard LEGO piece library or the base library of the Stud.io software. If the model is built strictly from official parts, the Designer must indicate its absence in this field.

3.3 Each submission is sent for Moderation. The Platform undertakes to review the submission within 10 business days.
3.4 The Platform reserves the right to reject the publication of a Digital Product without giving reasons, including cases of low technical/visual file quality or suspicion of third-party copyright infringement.
3.5 The Designer agrees to draft the product description in such a way that the End Buyer is clearly informed of the presence and volume of custom parts prior to purchase.

4. Intellectual Property and File Security

4.1 Retention of Rights: The Designer retains all copyrights, neighboring rights, and exclusive rights to the files uploaded by them.
4.2 License to the Platform: By uploading files to the Site, the Designer grants the Platform a non-exclusive, royalty-free, worldwide license to use the materials within the following scope:

  • .io files (3D Models): Used by the Platform within the internal closed technical circuit of the Site to render (generate) preview images. The original .io file is completely protected against downloading by third parties. The Designer gives their express consent for the Platform to automatically extract technical data from the .io file to generate the Part List.
  • Buyer Rights to the Part List: The Designer agrees that the generated Part List is made available for download to the End Buyer's device. The Buyer has the right to use this file to import onto third-party marketplaces (e.g., BrickLink, BrickOwl, etc.) to purchase physical parts for building the model.
  • PDF Files (Instructions): Used to display the content to End Buyers who have paid for the product.

4.3 Digital Rights Management (DRM) Protection: The Platform provides built-in technical protection for PDF files. The End Buyer receives access to view the instructions via the Site's web interface without the ability to download the file to their device or take screenshots using standard browser/Site methods. The Designer acknowledges that the Platform exerts commercially reasonable efforts to protect the content but cannot guarantee absolute protection against screen capture by external physical devices (e.g., a phone camera).
4.4 Consequences of Agreement Termination and Product Removal: The Designer has the right to stop selling a product or delete their account at any time. In this case, new sales will cease. However, the Designer grants the Platform a perpetual, irrevocable, and royalty-free license to store and display the Digital Product, as well as to provide the Part List, exclusively for those End Buyers who purchased the product prior to its removal by the Designer.

5. Financial Conditions, Commissions, and Payouts

5.1 Pricing: The Designer independently sets the sale price of their Digital Product. The minimum allowable price for a product is €4.99 (four euros and 99 cents).
5.2 Revenue Distribution: Upon a purchase by an End Buyer, the distribution of funds occurs strictly according to the following formula:
{Net Income} = {Product Price} - {Stripe Payment Processing Fee}
17% (seventeen percent) of the Net Income is retained by the Platform as a fee for marketplace services.
83% (eighty-three percent) of the Net Income is credited to the Designer's Internal Balance.
5.3 Withdrawal of Funds:
The minimum amount required to submit a withdrawal request is €50 (fifty euros).
Payouts are processed within 10 business days from the date of the request. Correspondent bank charges or payment system fees for transferring funds are deducted from the payout amount.
5.4 Quality Claim Resolution and Refund Procedure:

5.4.1 Notice of Defect: In the event of a justified complaint from an End Buyer regarding a defect, missing/inaccurate custom parts in the "Additional" field, or non-conformity of the Digital Product to its description (pursuant to Sec. 4.3 of the Terms for Buyers), the Platform shall send a notification to the Designer via email and duplicate it to their personal dashboard.
5.4.2 Correction Period: The Designer is granted 7 (seven) calendar days from the date the email is sent to rectify the errors and upload the corrected version of the files to the Site or adjust the description.
5.4.3 Consequences of Non-Compliance: If the Designer fails to correct the defects within the specified 7 calendar days, the Platform will issue a refund to the End Buyer.
5.4.4 Financial Deductions: When a refund is processed due to an uncorrected defect, the amount previously credited to the Designer's Internal Balance for that sale (83% of Net Income) will be deducted from their Internal Balance. If the balance is less than the refund amount, the Internal Balance will acquire a negative value (go into the minus) and will be automatically covered by subsequent sales made by the Designer.

6. International Tax Compliance (DAC7)

6.1 In accordance with EU Directive 2021/514 (DAC7), the Platform is legally required to collect, verify, and annually report information regarding the income of Designers to the Estonian Tax and Customs Board (MTA).
6.2 Upon reaching a payout volume of €2,000 per year or upon completing more than 30 transactions, the Designer agrees, upon request by the Platform, to provide verification data (Full Name, address, date of birth, Tax Identification Number (TIN / Isikukood)).
6.3 Failure to provide the requested data within 30 days entitles the Platform to temporarily freeze the Designer's Internal Balance and suspend any further payouts.

7. Designer Guarantees and Liability

7.1 The Designer guarantees that the provided materials are their original creation and do not infringe upon the intellectual property rights of any third parties.
7.2 If the instructions are created to complement building sets of well-known brands (e.g., LEGO), the Designer agrees to use standard text disclaimers ("This product is not sponsored or endorsed by brand X"), ruling out any misleading of consumers.
7.3 The Designer bears full responsibility for the accuracy of the custom parts list specified in the "Additional" field. The discovery of hidden custom parts not specified before purchase is equated to a product defect (Sec. 5.4).
7.4 The Designer agrees to indemnify and hold harmless the Platform against any claims, lawsuits, or penalties from third parties related to intellectual property rights infringements and to fully reimburse the Platform for any losses incurred.

8. Amendments and Termination of the Agreement

8.1 In accordance with EU Regulation 2019/1150 (P2B), the Platform has the right to amend this Agreement, notifying the Designer via email at least 15 (fifteen) days prior to the amendments taking effect.
8.2 If the Designer does not agree with the modifications, they have the right to delete their account within the specified period and withdraw the remaining balance (provided it exceeds the minimum limit).
8.3 This Agreement is governed by and construed in accordance with the substantive law of the Republic of Estonia. All disputes shall be subject to the jurisdiction of the Harju County Court (Harju Maakohus) in Tallinn, Estonia.
